Annoying loud neighbours

      I've had problems with neighbours most of my life. I used to live in a flat and the neighbours below were polish and rented out the property. They were there for only about 6 months and it was hell, parties every night lasting till 4am.

      It is very hard not to when I say this, but don't sink to their level. There are laws in place to protect people from noise, but unfortunately it takes forever for them to be used. Contact your local council, all properties, even rented ones are covered by the council's laws on noise.

      There should also be an out of hours number to call when the office is closed, officers will then come round and see for themselves how noisy it is. This is what I did. I also contacted the letting agents and then they passed my concerns onto the landlord. Polish people, sometimes just float around the country between work so they will probably be gone in 6 months.

      The law says that you can't play loud music beyond 11pm, but you can also complain about loud music played or nuisance noises in the day. If you can prove that it is affecting your state of mind then it also helps your case.

      I think you're lucky that at least they are renting it. If they owned the property then it would take the council a lot longer to move. I had this when I was a kid, it took my parents 3 years of diary keeping before the council put and enforcement in to seize the music equipment.

        I would also respectfully suggest you contact all your local Councillors in your ward to make your feelings known. They are your local elected representatives and must take your case seriously, keep pestering them to get some action.

        Thankfully we have never had problems with noise but we have had big problems with a few neighbours trying to turn their gardens into building plots. We were woken early one sunday morning by chainsaws cutting down trees opposite us to try and make an entrance into their back garden, within an hour we got the council to come out and put tree preservation orders on the remainder. The mayor turned up in her slippers personally to do it. That was only that start of several years of battles which our local councillors did help us with and eventually the developers gave up and moved on. But we know they will be back sooner or later. Not the same problem as you I know but we couldn't have stopped the destruction without our local councillor's help.

          I feel your pain Kyle. The most annoying thing about anti-social neighbours is that when they want to rest and have peace and quiet, there's no-one to disturb them.

            Dude, no matter your feelings on him it's not great to post his name etc on an open forum, in the remote possibility he finds out about it, gets upset and starts legal wranglings. Sad state of affairs but he sounds the type.

            That said, I've had a look myself and I see you could start posting on his facebook page, linkedin profile or his own blog... His entire ethos is to cut cost so he won;t be very receptive to having to do anything

                Hi Kyle, I was going to private message you about what has been said to my wife, but I think everyone will be interested.

                The Bench Legal Advisor (They make sure that what happens in a Magistrates Ct is lawful and correct) that my OH spoke to says unfortunately there is no action an individual can bring regarding ASBO's. He reiterated the role that the council have and as has been suggested by others, a letter to the Councillor for your ward, should get action if you have no joy.

                The Landlord, has both a duty of care to the tenant AND the community, it's all part of the newish regulations, failure to comply by the Landlord can mean his license can be revoked. Assuming of course he has one, and if he does not then that is also a breach of regulations, so either way he would be in trouble, punishable in a court of law.

                I am sorry I couldn't bring you better news, but would urge you to keep on at the Establishment, your Council has a duty of care that includes you, and if they continue to ignore your complaints, I would be tempted to seek legal redress. You have 3 months worth of evidence, that should be enough to show the neighbours as being unreasonable, therefore anti-social.

                  We have 8 months worth of evidence! I got bored typing it out after May as it was probably over 100 nights since Feb 8th.

                  And I've emailed all three councillors on Eccles' ward, so hopefully one replies!

                  I've had some other advice off someone who deals with noisy neighbours and gives out advice, etc, they've given me some links and told me not to confront the tenants as people like them don't consider anyone's feelings and probably wouldn't make them stop anyway.

                  Last night wasn't too bad. But I'm guessing even they can't drink 24/7!

                      I never email important people with complaints etc as so many of my emails have "disappeared" in the past. When you do deliver the diary to the council then do it by hand to their offices, never by post. My parents did this and we had to write out a whole new diary as the council never got the first one.

                          P'S, the Poles were up til 3am shouting and screaming keeping my mum up, she now wants to go to the landlord's house to pretty much confront him.. probably lack of sleep and the fact it's boring now after 8 months.
