Over hanging tree

    Trouble with ringing a HA you don't know the level or experience of the person answering the phone, I would write back stating that they must keep to their promise, so as not be drawn into an argument.

      You could send a copy of your letter to the tenant who will then know it's up to the HA to act.

        She sounds very young and out of her depth and has very little experience, she tried to make up with that with her endless nonstop drivel about her neighbour's tree overhanging her back garden screeching away saying:
        "I know a lot about this"
        I don't think she is right but her input can only inflame the situation if the tenant hears what she is saying making it harder to deal with.

        Yes it's your tree. Yes it's overhanging and being a nuisance. It is not a threat to safety as the branches are healthy, nor so severe as to cause direct obstruction or at a level where it might poke someone in the eye, for example.
        They're just bullying you and trying not to pay for someone to chop back the offending branches.
        It's actually down to the tenant, then the HA, but it is NOT your obligation. Tell them to check with the council, the RHS, about a billion internet results, they all say the same thing.

            You mention you are all retirement age. When I looked at the picture, it seemed to me that using that laneway, it wouldn't be hard to use a pole saw to lop it off. Perhaps if you told them, no, it is definitely not your responsibility to cut it back but since you are all seniors, perhaps you could all work together to lop it and chop up the branches.
            I'm a couple of years away from 70 and that doesn't seem like a big deal to me, but then again, I am tower of a woman!:heehee:

            Over here, the hardware big box stores rent out pole saws and such quite cheaply. I'd lend you mine but it's a little far for you to pick up!

            If they refuse to take part in a solution, then tell them, it's not on your property and walk away.

            Or if you don't want to offer anything then tell them no, not your problem, end of story.

              Its not down to the tenant as it overhangs what appears to be an alleyway, the hedge needs trimming also.
              Surely the tenant can only cut back the branches overhanging their property, which wouldn't solve the problem.
              The housing association needs to sort it out, personally I'd be out there with SBK in this situation, as I dont think anyone particully wants the tree, and nobody want responsibility for it.

              Do we know what the species is?

              I was just about to mention that from the photos attached, the tree (ash) looks like it's suffering from dieback - probably Chalara, and I wouldn't be so bold to state on a public forum that anything is 'safe'. No arborist / consultant worth their salt uses the 'safe' word.

              Weedaway - you might just have to suck it up and get it done. To me it looks like it's got ash dieback and will begin to drop bits before it eventually (probably) turns stone dead. Be a responsible tree owner and deal with it the best you can. If you can afford a professional tree surgeon to get it done, then great. They'll deal with the whole thing for you. Beware the gypsy / traveller / four-blokes-in-a-transit-van brigade.

                For those who advocate that individuals should do other people's overhanging tree cutting would you like to come round and do the job? let me know when you are coming! sounds fair to me!

                      Following the leads of it not being my responsibility I did some searching into this, now I have a better idea of what I am looking for, I found this below and no end of the same thing coming to the same conclusion:

                      “Overhanging Branches on Your Property

                      Even if the tree trunk is on your neighbor's property, you have the responsibility for cutting any branches that extend onto your property line. You are responsible for the cost of cutting any branches you choose to trim. You can cut back anything up to your property line”.

                      The picture I attach below shows the branches prior to leaf and how the branches are situated on the very edge of my boundary making it impossible to cut without being on the other side of my boundary, so according to UK law, the responsibility is as above, in this case, the tenant and or the Housing Association.

                            Probably an American web site going by the spelling, I imagine the law is different over there.
