Is it legal?

    Yo!
    Can I legally trim back my neighbours bush if it enters my gardens airspace?
    I have asked her before to keep her garden under control, because the gas man went mental one year. Apparently it's dangerous to cover the hole I have in my wall. He ripped it down without asking :ouch1: he wasn't amused. She hasn't done anything to help though.
    I have added 2 pics. You can see where it was attached to the wall near the hole. There are marks around it. So can I trim other people's gardens legally? IMG_00000042.jpg IMG_00000043.jpg

      Yep, you can cut off anything that overhangs or intrudes into your property, but the clippings still belong to the neighbour.

      You have to place them back on their property, (not just lob them over)

        The friendly approach would be: knock on their door, let them know you are going to be trimming the overhang.

        The "legality" is (to the best of my knowledge - and I have no doubt I'll be corrected if I'm wrong :heehee: ) that you have the right to trim anything which overhangs your fence (but not beyond it to their side) *but* you must offer those cuttings/trimmings back to the neighbour :blue thumb:

        Plus, your gas man was quite correct: that flue should not be obstructed. But, I'm now wondering ... :scratch: ... aren't those flues meant to have a cage around them nowadays? :noidea: (Again, someone will correct me if I'm mistaken :redface: )

          I'd like a look at the rest of her garden as one or two of those shrubs look interesting! But variegated Ivy - what is that about!:runforhills: Let herself down badly there IMO.

          Anyway, I agree with the above, although as I say some of those shrubs look interesting. Personally I'd keep me gob shut and set about killing that Ivy on the QT:whistle:

            I can handle the bush when it's in bloom, but I don't want it when it's dry and sticky looking :sad:

              As others have rightly said, you can cut off anything that is in your space.

              You really need to keep the flue clear at all costs. The gas man went mental for good reason. If the flue is obstructed, carbon monoxide will fill your house and kill you as you sleep. You wont even know its happening. You can't smell, see or taste it, you'll just feel tired and relaxed and sleepy, while it displaces the oxygen in your blood and silently, painlessly, kills you of death.

              So I'd take it seriously. Keep it clear. Don't count on your neighbour doing it. Too often they simply can't be bothered.

                  OMG! :loll: I've clearly had a glass of wine and my reply would be unprintable (even if I tried!)

                  Killing someone is illegal under common law: trimming someone's bush is ... open to interpretation. :whistle:

                    Assuming the regulations are the same on the mainland as they are here, if the flue is under 6ft from the ground it should have a cage. Ours is under height (about 5ft 6in) and we were told it should have a cage (health and safety), we haven't bothered because I'd rather crack my head on a plastic flue than the corner of a metal cage that is more prominent!
