I love your patio as well, it's gorgeous :wub2:

She looks almost like a Camellia in that pic, which has reminded me that it wasn't just tons of Roses I bought this year - I've got lots of young Camellias as well but I think I'll have to wait a while for those to bloom.

As you probably know one of my favourite roses is Masquerade which has flowered all through the year and is still flowering. But it's the way it changes colour from yellow to red as the flower ages that always enthrals me.

          Here's it last night:

And here's it today and you can see the petals starting to redden.

It's one of my all time favourites and has paid me back so much after paying 50p for it as a packaged dry root from a now defunct Supermarket over 30 years ago.:snork:

I'm not sure whether or not the patent time will affect the commercial proliferation of Masquerade, Woo, in that it will mean that Commercial Growers will not now have to pay royalties, which is an encouragement rather than the reverse.. I think Masquerade will be continued to be grown as long as there is a demand.:snork:

Hi Armandll yes but it will have another name ,there are literally 1000,s of Roses that disappear every single year ,just a few are renamed ,and the majority of these were indeed very popular and selling well but didn't suit the growers and breeders for different reasons that's the rose world for you:cool:

Hi Grumpy :) I am still in the process of researching this subject so please bear with me;)

Search on the rose's registered name (usually a code name that begins with the breeder's three letter prefix, and you will get a summary of the actual patent ... if there is one. According to the Patent Office, plant patents run for 20 years from the date of application. Many roses were never patented, so are pretty much fair game to propagate no matter how old they are.

It is illegal to propagate trademarked roses released less than 17 years ago because they are still under patent.

To get around the limitation on patent protection, some rose breeders are protecting their intellectual property by trademarking the name of the rose. Once the patent expires, it is legal to propagate, but the rose cannot be referenced except by the official name.

This is why Austin roses, in particular, are listed in nursery catalogs as AUSblush (Heritage) or AUSmary (Mary Rose).
