      1. Looks like Gaultheria mucronatum. Possibly a male plant which is why there are no berries.

Buy Gaultheria mucronata (Male) (Male Prickly Heath (Pernettya)) in the UK

99.9% sure it is not Ruscus aculeatus. Common name butchers broom. This has flowers on the flatten cladodes ( looks like a leaf) which form berries that sit on the cladodes.

      2. Agree with Ziggy.

You could be right there, looking again it doesn't look spikey enough.

Does it make you scream when you touch it Hydrogen ? If not then its not Butchers Broom:parsnip:

No It's quite ok to touch...It does not scratch you like holly bush do. Got it when it was really small and planted it out...it was starting to get berries on it but then it started to die so I put it back in its pot and forgot all about but now it looks like its coming back to life...will just leave it in the pot seems happy enough there! Think the rubber plant will need to come inside soon....thanks for your replys folks.

Sorry guys I am mistaken. It is actually quit spikey especially for such a young plant. If you look in the centre of the pic you can actually see a few of the fruits forming.
