    I can't see them applying it to charities, clubs and hobbyists. It would only be to commercial enterprises as it would be impossible to administer and enforce.

    Last year we supplied plants to seven church plant sales, three gardening club sales and three charity sales. None of the money comes to us.

    Trying to administer the scheme to all the gardeners and allotment holders around the country would take an army of inspectors. within a radius of 10 miles around us I know of at least forty plant sales where the plants are just from 'the man in the street'. :noidea:

    i know that the idea is supposed to be plant health but it just doesn't work that way. What about if you grow plants for family and friends but don't charge? :)

      I don't think that registration applies to plant swaps and giving plants away which is the bit that I struggle with. Is this about plant health or stealth tax ? How can a free plant be less prone to disease than one you buy ?

        I totally agree. I think the regulations only apply to selling wild plants and those that are EPS (European Protected Species).

        In theory, all plants sold should have their origin shown but that simply just needs a notice saying 'Grown Here' if you're selling at home - or grown locally.

        I have been through all this with different Apha staff & the bottom line is anyone selling plants via distance selling must register to supply plant passports, face to face sales are exempt, gifting & charities are in the grey area that always occurs with regs. If you are growing plants to sell face to face you must be registered as a grower but don't need to issue PP's
        This year is a grace year, next year the fines will start.
        If you are unsure contact the relevant Defra dept. for your country.

        They don't normally bother with charity and gifting as there would soon be an outcry about the grey area of distinctions between all different versions of it.

        e.g. Giving plants to a parent, giving plants to a local cemetery, planting out a pensioner's garden with plants from your garden etc.

        Selling could also be a very grey area. It reminds me of a market trader, many years ago, that was reported for selling perfume samples because they contained some alcohol. The trader got away with it because he advertised, and stated, that the perfume samples were free samples and he just had to charge for the bottles to cover his costs!!! :heehee:

        Note: You will need to complete this form if you are professionally involved in planting, producing, breeding, moving, storing, dispatching or processing of plants or plant products.

        No mention of amateurs, hobbyists ect.
        Also they request to fill in digitally as it is a PDF documenr not everybody has this ability.

          It's free to register as a grower, if you apply to issue PP's you will get a visit from an inspector, I believe the initial visit is free & as I said the charges for hobbyists are under review.
          This is just the first stage in regulations covering plant growing, I hate to think what the next stage will be.

            Thanks @NigelJ I'll look into this. My understanding was that there is an inspection carried out for the plant passport which carries a fee of £120 minimum - hopefully I'm wrong

              The forms are worded for professional growers/suppliers, I think the powers that be overlooked hobbyists but they are very much included in the regs.
